The new rule, implemented by the California Department of Social Services (CDSS) as part of a statewide administrative directive, creates a hard cutoff: any IHSS application that has been pending for more than 90 consecutive days without adequate documentation — particularly documentation verifying immigration status or lawful residency — will be automatically denied on or after May 18, 2026.

Appeal window: You have 90 days from the date of the denial notice to request a State Hearing. This is your formal appeal. During a hearing, a state administrative law judge reviews whether the denial was procedurally correct. Reapplication: You can also simply reapply with a complete, corrected application. A new application starts a fresh 90-day window. The drawback: you lose any retroactive benefits tied to the original application date, which in some cases means losing months of back payments.

Expedited review: If the applicant is in immediate danger of harm due to lack of care, you can request an expedited review — typically processed within 10 days. This requires documentation from a physician confirming the urgency.

Can a family member act as the IHSS provider after the application is approved?
